These Terms of Service ("Terms") govern your access to and use of the RGBA platform ("Service") operated by RGBA ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this age requirement and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
You must sign in with a Google account to use the Service. You are responsible for maintaining the security of your account and all activity that occurs under it. You agree to provide accurate information and to notify us promptly of any unauthorized use of your account.
RGBA is an AI-powered platform that generates video content based on user-provided images and text prompts. The Service uses artificial intelligence models to generate concepts, images, and videos. Results may vary and are not guaranteed to meet specific expectations.
RGBA offers free credits upon registration and paid subscription plans (Basic at $20/month, Pro at $100/month). Paid subscriptions are billed monthly through Stripe and automatically renew unless cancelled.
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods unless required by applicable law.
We reserve the right to change pricing with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.
Video generation consumes credits from your account. Credit balances are non-transferable and have no cash value. If a video generation fails due to a system error, credits will be refunded to your account. Unused credits from free allocations may expire; subscription credits renew each billing cycle per your plan terms.
You retain ownership of any images and text prompts you upload to the Service ("User Content"). By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store your content solely for the purpose of providing and improving the Service.
You are solely responsible for ensuring that your User Content does not infringe on any third-party intellectual property rights, violate any laws, or contain harmful, obscene, or illegal material.
Subject to these Terms and any applicable third-party AI model terms, you own the videos generated through the Service using your inputs. You may use generated content for personal and commercial purposes. We do not claim ownership of your generated videos.

The Service, including its design, features, code, and branding, is owned by RGBA and protected by intellectual property laws. Nothing in these Terms grants you rights to use our trademarks, logos, or branding without prior written consent.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE MAKE NO GUARANTEES REGARDING THE QUALITY, ACCURACY, OR SUITABILITY OF AI-GENERATED CONTENT. THIRD-PARTY SERVICES USED BY THE PLATFORM (INCLUDING STRIPE, OPENAI, AND REPLICATE) ARE PROVIDED UNDER THEIR OWN TERMS AND WARRANTIES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RGBA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, REVENUE, OR PROFITS. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless RGBA, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service, your User Content, or your violation of these Terms.
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including ownership, warranty disclaimers, and limitations of liability) will survive.
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of laws provisions.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
